IER Standard Terms and Conditions
Payment Terms
- For customers without established credit, IER accepts Zelle, Wire Transfer, and Prepayment.
- Alternative payment methods, such as Cash App, may be available upon request and approval by IER.
- IER does not accept Credit Cards for labor or shipping costs.
Free Estimates & Unrepaired Units
- IER provides Free Estimates for all units.
- If a unit is determined not repairable, the customer may:
- Request the unit be returned at their expense (a $25+ return shipping fee applies).
- Request the unit be scrapped/discarded by IER at no charge.
- All labor charges and rush fees are non-refundable.
- Due to high call volumes, response times may vary, especially during peak seasons. Customers are encouraged to email for quicker responses.
Abandoned Units
IER is not responsible for any units left for more than 60 days, whether the customer has signed this agreement or not, per NC Gen Stat § 66-67.1 (2023).
After 60 days, unapproved units may be recycled or sold at IER’s discretion.
Customer Conduct & No Harassment Policy
IER is committed to providing a professional and respectful environment for both customers and employees.
Abusive, threatening, or harassing behavior toward IER staff, whether via phone, email, or in person, will not be tolerated.
IER reserves the right to refuse service, cancel repairs, and terminate communication with any customer engaging in harassment, including but not limited to:
- Excessive or aggressive calls/emails.
- Verbal abuse, profanity, or threats.
- False claims, chargeback fraud, or unwarranted complaints to authorities.
If necessary, IER may involve law enforcement or take legal action against individuals engaging in harassment.
Warranty Terms
- IER provides a 12-month standard warranty against defects in material and workmanship from the date of shipment.
- The warranty does not cover:
- Cosmetic damage or abuse occurring during use within the warranty period.
- Units that have been misused, neglected, improperly installed, physically damaged, or altered (internally or externally).
- Damage due to improper use or operation in an unsuitable environment.
- Repairs performed by any party other than IER.
- In-warranty repairs apply only to electronic functionality issues repaired by IER.
- Cosmetic or mechanical issues are not covered under warranty and will be subject to IER’s standard repair estimate program.
- Technical support is only available to customers who are paid in full.
- The warranty is void if payment is not made within the terms specified under the Terms of Payment.
Shipping and Customs Responsibilities
- The customer is responsible for all customs duties, taxes, and shipping charges for items shipped to and from IER, including any warranty return claims.
- No refunds will be given for shipping or labor costs.
Repair Requoting
IER reserves the right to requote any repair if necessary due to expensive parts or multiple repair attempts.
Limited Liability
IER’s sole obligation for warranted units is to repair or replace any defective parts replaced by IER, at IER's discretion.
IER shall not be liable for any refunds or damages, including but not limited to:
- Special, direct, indirect, incidental, exemplary, or consequential damages.
- Business interruption, lost profits, savings, business information, or any other damages resulting from repair services.
Order Acceptance
All orders are subject to the terms and conditions listed in this IER Service Agreement and no others.
No waiver, modification, or alteration of these terms shall be binding unless in writing and signed by an executive officer of IER.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
Any claims or disputes arising out of or related to these Terms shall be filed only in the state or federal courts of North Carolina.
The customer expressly agrees to the jurisdiction of such courts for any legal actions.
Customer Approval
This Agreement constitutes the entire contract between the parties concerning the subject matter and supersedes all previous marketing materials, communications, representations, and agreements (verbal or written).
